1. Purpose



This privacy notice sets out the standards that you can expect from Dr. Frances Berry and staff, when we request or hold personal data (‘personal information’) about you, how you can get access to a copy of your personal information and what you can do if you think the standards are not being met.



2. Who we are



Dr. Frances Berry and staff collect and process personal data for the purpose of providing health care. Our Data Protection Officer is the person responsible for ensuring we comply with our data protection obligations.



3. About personal information



‘Personal information’ is information about you as an individual. It can be your name, address or telephone number it is also information about your health and treatment: which is classified as sensitive personal data. We know how important it is to protect our patients’ privacy and to comply with data protection laws. We will safeguard your personal information and will only disclose it where it is lawful to do so.
We only process personal information that is relevant to the services we are providing to you. Our medical records may also contain information we receive from other health professionals.


4. Purpose of processing and the lawful bases for the process



Under data protection law, our lawful bases for processing:
Personal data is: The processing is necessary for the purposes of legitimate interest pursued by the data controller or by any third party to whom the personal data are disclosed.
Sensitive personal data is:The processing is necessary for medical purposes and is undertaken by –A health professional orA person who in the circumstances owes a duty of confidentiality which is equivalent to that which would arise if that person were a health professional.Please note that we do not rely on your consent in order to process your personal information. We may need to share your personal information with some other people and organisations so that we can provide you with the best care we will endeavour to inform you before doing so.
The extent to which we need to share your personal information will be determined on a case-by-case basis according to what is reasonably necessary to provide you with the best care. As consent is not the lawful basis on which we process your personal information, you cannot withdraw your consent to the processing of personal information.
We will use the personal information we collect only for the purpose of health care and to assess the level of service we provide. We may compile and publish statistics showing general information, but not in a form which identifies any individual.


5. With whom will your information be shared?



We may need to share the personal information we process with other organisations. Where this is necessary, we will comply with all aspects of the data protection laws. As well as members of our own staff, we may need to disclose your identity and details of your treatment to other medical professionals and health care services including medical insurance organizations. We may also need to share your personal data with organizations for the purposes of collection of payment and accounting. In some circumstances, we may need to share details of your health care with other third parties, such as your employer or other relevant government agencies. Such disclosures will be made in accordance with data protection laws.



6. Storing your information



We will keep the information contained in medical records in line with the Ministry of Health and Wellness’ Minimum Record Retention Periods. This means that information contained in your medical records will be retained for a designated number of years from the date of your last appointment. We will retain personal information in a secure environment and access to it will be made only where required for our statutory purposes.



7. Your data protection rights



Under data protection law, you have rights including:

  • The right of access – You have the right to ask us to tell you what information we hold about you and also to request copies of your personal information. You will need to pay a fee for copies.
  • The right to rectification – You have the right to ask us to rectify personal information we hold about you that you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • The right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.
  • The right to object to processing – You have the right to object to us using your personal information in certain circumstances.
  • The right to object to direct marketing – You have the right to object to your personal information being used for direct marketing unless you have given your consent for us to do so.
  • The right to object to automated decision making – You have the right to object to any decision being made about you using solely automated means.

8. When we ask you for personal information



We ask only for the personal information we need and will not collect information that is irrelevant or excessive. We will never share your personal information for commercial use or any purposes other than to provide you with medical care and associated lawful purposes.
